On 26 October 2020, the Court of Justice of the European Union announced receiving a preliminary ruling request from the German Federal Court of Justice arising from a case involving Facebook Ireland Limited.
The question referred to the CJEU in case C-319/20 is weather the GDPR precludes national rules allowing competitors, entities, associations, and chambers entitled under national law, to bring proceedings before the civil courts for breaches of the GDPR independently of the infringement of specific rights of individual data subjects and without being mandated to do so by a data subject, on the basis of the prohibition of unfair commercial practices or breach of a consumer protection law or the prohibition of the use of invalid general terms and conditions.
