On 18 March 2021, the French DPA (“CNIL”) released an updated version of FAQs on its guidelines and recommendations on cookies and other trackers, coming into force on 1 April 2021.
The updated FAQs include, among others, further detail on tracking devices that are exempted from the requirement to obtain data subject’s prior valid consent, such as those not used for audience measurement purposes, social media plug-ins, guidance on implementing the Privacy by Design principles, and the manner in which users should be able to opt-out from the use of cookies and other trackers.
