On 4 January 2021, the German Federal Network Agency (“Bundesnetzagentur”) announced imposing a EUR 145,000 fine on a company in the telesales sector for carrying out unauthorized telephone advertising.
In this context, Bundesnetzagentur identified that the company made these phone calls without holding a valid consent and after the specific requirements of data subjects to not carry out such calls in the future.
In addition, Bundesnetzagentur identified that the company had acquired new customers through a telephone campaign without holding their consent. This aspect has not been dully checked by the company prior to this telephone campaign.
The fine is not yet legally binding as the competent court of law will have to decide on a possible objection.
