CJEU imposes financial penalties amounting to EUR 15.5 M against Spain for failure to transpose the Law Enforcement Directive

On 25 February 2021, the Court of Justice of the European Union (“CJEU”) issued its judgment in case C-658/19, ordering Spain to pay a lump sum of EUR 15.5 M and a daily penalty payment of EUR 89,000 for its ongoing failure to transpose the Law Enforcement Directive and to notify the transposition measures. The daily penalty of EUR 89,000 is due from the date of delivery of the judgment until the infringement established has been brought to an end.

This judgment is the first in which the CJEU imposes, pursuant to Article 260 (3) of the TFEU, the two types of financial penalties concurrently.
