On 5 March 2021, the Romanian Ministry of Justice opened a public consultation on the Draft Law regarding the protection of whistleblowers in the public interest. The proposed draft aims at being an instrument designed to encourage the reporting and, consequently, the discovery and sanctioning of such acts, and to protect such persons by granting the whistleblower in public interest status against any adverse professional or personal consequences to which they may be exposed as a result of the transmission of a complaint.
Among others, this draft establishes measures for the protection of staff in public authorities and institutions, who report certain irregularities or illicit acts committed within these entities, and also regulates the obligations of private entities, being proposed for the transposition of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law.
This draft is subject to public consultation for a period of 20 working days as of its publication.
