On 20 August 2021, the Maltese DPA released a brief guidance note on cookies consent requirements, aiming at assisting operators when using cookies in online services.
In a nutshell, this guidance outlines how cookies should be approached by reference to the current ePrivacy Directive and the GDPR, as well as several Article 29 Working Party and EDPB opinions. In this respect, the Maltese DPA provides some examples of uncompliant practices, such as cookie walls and pre-ticked boxes, and also an example of a good-practice approach to ensure compliance.
