From Governance to Enforcement: What Applies Under the AI Act as of August 2025

On 2 August 2025, a new set of provisions under Regulation (EU) 2024/1689 on Artificial Intelligence (the AI Act) became applicable.

As of this date, the following main provisions have entered into force:

  • The formal establishment of the European AI Board – this body has already been constituted and has held several meetings. We expect the AI Board to play a key role in the EU AI governance framework, including through the issuance of recommendations and written opinions.
  • The rules governing General Purpose AI (GPAI) models – notably, just one day before these obligations became applicable, the European Commission and the AI Board confirmed that the GPAI Code of Practice is recognised as an “adequate voluntary tool” for providers of GPAI models to demonstrate compliance with the AI Act.
    Note: The GPAI Code of Practice is a voluntary instrument, developed by independent experts, intended to support providers of GPAI models in meeting their obligations under the AI Act.
  • The designation of notifying authorities and notified bodies – it remains to be seen which authority/authorities will be entrusted in Romania with the responsibilities of notifying authority (this being the main regulator under the AI Act).
  • The enforcement and sanctioning regime – the general enforcement provisions of the AI Act are now applicable, with the exception of the fines specific to GPAI providers – in a nutshell, the AI Act sets out a tiered system of administrative fines for non-compliance. Violations of the prohibition on certain AI practices can trigger the highest fines—up to EUR 35 million or 7% of global annual turnover. Breaches of other obligations may lead to fines of up to EUR 15 million or 3% of global annual turnover. Providing incorrect, incomplete, or misleading information to authorities can result in fines of up to EUR 7.5 million or 1% of global annual turnover.

We also recall that 2 February 2025 marked an earlier milestone in the implementation of the AI Act, with the entry into force of:

  • the provisions on prohibited AI practices, and
  • the requirements related to AI literacy.
