Germany’s Federal Court ruled that consent is necessary for non-functional cookies

On 28 May 2020, Germany’s Federal Court announced its own decision in the Planet49 case, which was until recently suspended due to a request for a preliminary ruling.

Germany’s Federal Court confirms that prior informed consent is required for the cookies used to track on-line behavior and pre-ticked boxes are invalid, in line with the CJEU decision in this case.
